Any use of www.ceylon luxurytours.com website, or written communication with Ceylon Luxury Tours, for the purposes of travel arrangements, confirms that you are aged 18 or over and that you have read and fully understand, and accept these terms and conditions. These terms and conditions are devised for the protection of all parties.
The Ceylon Luxury Tours website is owned and operated by Ceylon Luxury Tours, with office located at 530/A Daluwakotuwa, Kochchikade, Sri Lanka 11540. You are welcome to request special arrangements when you are booking through our website. However, we cannot guarantee to supply all the requests, but we will do our best to arrange it during your booking period. your reservation will become confirmed once you have sent an on-line confirmation and provided your credit card details, and paid the 10% amount due in full OR any required deposits and when we acknowledge receipt of your deposit. In some cases, an initial non-refundable deposit may be charged.
A booking is accepted only after we receive online booking confirmation from you along with a 10% payment, which is non-refundable in any cancellation of the value of the Travel Arrangements. (This may be waived solely at our discretion). Once you arrive in Sri Lanka, then full payment is required at the time you start our service. Full payment OR the payment of a deposit and your booking confirmation will indicate an acceptance of these terms and conditions by you.
The balance of payment due for Your Travel Arrangements if any must be paid by you not later than 2 business days after arrival in Sri Lanka; otherwise we may treat the booking as cancelled by you.
Payments for deposits and final monies for Travel Arrangements may be made either by;
1. Booking through the website using Master or Visa card ( 50% confirmation Fee )
If paid by bank transfer any charges arising outside Sri Lanka should be borne by the remitter.
If paying by credit card a secure internet payment gateway facility is available. A handling fee of 2.65% is charged additionally on the top of the invoice value agreed. You can use both credit and debit cards for payments.
If paying by credit or debit card through the secure internet online payment gateway:-
Your payments are processed entirely on the Secure Payment Sites operated by Hatton National Bank for Master and Visa card payments.
Your card details are not received or stored by Ceylon Luxury Tours in any form, and when you place an order as part of the checkout process you are automatically taken to the Hatton National Bank Secure Payment facility.
Payments can be done in all the four currencies , US$ ,Euro , GBP or LKR SSL, security internet protocol known as Secure Socket Layer, uses connection-oriented end-to-end encryption to provide data confidentiality service and data integrity service for application layer traffic between your web browser and the secured Hatton National Bank payment gateway servers. It provides data encryption, server and client authentication and message integrity between the client and the web server.
If you fail to meet the payment deadlines stated to you, we reserve the right to cancel your tentative booking and will inform you of this.
We provide our customers tailor-made land tours throughout our country. The price of Your Travel Arrangements includes the potential of changes and surcharges This is to cover the cost of changes in transportation costs such as fuel and government action such as changes in VAT or any other government imposed changes which are not within our control (and which have not impact on the cost of our services) We will absorb a cost increase for an increase arising from an increase in the price of oil, any change or imposition of taxes and or charges or in the exchange rates Shearings reserve the right to increase Your Travel Arrangements costs after your reservation was an example. Further, in the event that the price of Your Travel Arrangements is increased due to changes in the relevant currency exchange rate, transportation costs (including the cost of fuel), duties, taxes or fees or otherwise, you will be required to pay the amount of the increase to us provided that in no case will the increase amount to an increase of more than 2% of the total price of Your Travel Arrangements (excluding any amendment charges). Prices are quoted in US Dollars.
We reserve the right to charge 10% of agreed price for package in the event of you wishing to cancel the tour. However, if you are wishing to transfer the package, we will help you to arrange it withing the selected timeline in your booking.
While We will use Our best endeavours to provide all Travel Arrangements as confirmed, reasonable changes in the Travel Arrangements may be made without notice to You if deemed necessary or advisable by Us at Our discretion.
Cancellation of Your Travel Arrangements by You must be notified to us in writing, and will take effect the day we receive it.
It is the responsibility of you and the rest of your party to take the correct inoculation and medical advise before you travel. You are also responsible for making sure that you and those travelling with you, including those you have booked to travel with you (your party), have the appropriate passports and visas and have obtained all other necessary travel documentation before the holiday begins. If you need a little help on this one, we're always happy to offer suggestions. We will not accept responsibility for you travelling without appropriate travel documents.
You are strongly recommended to take out personal travel insurance, at the time of booking, for all members of your party. It is your responsibility to ensure that the insurance you purchase is adequate. Booking acceptance shall be deemed to include your confirmation that you have taken out such insurance. If required Ceylon Luxury Tours can also provide you personal travel insurance for the time spent in the island, please contact us for further details.
Under no circumstances shall we be responsible for any loss or damage resulting(including, for the avoidance of doubt, any direct, indirect, punitive, incidental, special, or consequential loss or damage) from the use of the Services other than where the performance thereof is directly involved. There are things you must do, adventures to be had along the way: water rafting, rock climbing, hiking, sliding, riding ATVs, cruising in a boat, and so forth. Disclaimer: We are not responsible for any losses, injuries or death occurring as a result of this adventure or your participation in activities. Convenience is supposed to be the moment you arrive, and you have to protect yourself once you are inside the hotel. I feel I should say You must have insurance for yourself and all who will come with you. No insurance: Insurance is also available for purchase.
You will be responsible for any breakages, losses or damage caused by you or a member of your party during your journey in the vehicle. It is your responsibility to put right the damage or to make full payment to the supplier before departure and to indemnify us against any losses, damages or claims made against us.
You are responsible for compliance with all applicable laws concerning carriage by air or other mode of transport during your holiday and your stay. In the event the team of our suppliers/service providers and/or guide representative consider your actions to be disturbing or dangerous, (i.e. causing discomfort, fear or injury to other clients, our staff or any other third party) your holiday may be terminated and we shall not be liable for any costs or claims.
If any of these Booking Conditions are invalid or unenforceable then subject to law, all other provisions of these Booking Conditions shall be and continue to be valid and enforceable.
When your booking is confirmed with us, a contract between Ceylon Luxury Tours and/or you is constituted. That contract and these Booking Terms and Conditions shall be governed in all respects by the laws of Sri Lanka.
We would like to be able to settle amicably any justified complaint that you may have concerning the standard of your travel. You must, however, as soon as is reasonably possible, try to resolve any complaint about the service or facilities you directly with a direct supplier of the service e.g. Driver and you are required at the same time to let your travel Ceylon Luxury Tours representative and your travel counsellor know of any such complaint at the time it is made. If we are unable to settle your complaint, you can write to us making a formal complaint within 28 days of your return home giving us all relevant information. In the event that you encounter a problem, you are requested to bring it to the attention of the supplier of the service/s involved as well as the appropriate Ceylon Luxury Tours local supplier and travel coordinator who made your booking, and if further action is required to address the problem, then a written complaint should be filed. If you don’t do this simple procedure, we can let you take responsibility since we’ve been given no chance to investigate and fix the problem. We want to continue to build on the service and products that we offer and would like to give you the opportunity to help us by providing a Customer Survey.
The holidays shown are offered by Ceylon Luxury Tours and can vary from luxury to budget. And we are going to plan the very best we can. But amenities and infrastructure aren’t necessarily as developed in Sri Lanka at times. Naturally, travel can be delayed, uncomfortable and potentially hazardous. Insects in rooms are a typical occurrence in the tropics. It is more or less a fact of life that any tourist perusing our menu of offerings is to some degree resigning him or herself to this fact. The above guidance is general and clients should take reasonable precautions at all times and, if booking a holiday, consider up-to-date information on the issues raised.
You agree to defend and indemnify Ceylon Luxury Tours (its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents) from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by: (i) you or on your behalf in excess of the liability described above; or (ii) by third parties as a result of (a) your breach of this agreement or the documents referenced herein; (b) your violation of any law or the rights of a third party; or (c) your use of this website.
When you visit our website or otherwise communicate with us electronically, you are communicating with us electronically. By use of this site or subscribing, you agree to contact from us by WhatsApp and email. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically or via WhatsApp satisfy any legal requirement that such communications be in writing.
